1. Acceptance of Terms

Welcome to Real Cents Organized, LLC (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website located at https://www.realcentsorganized.com (the “Site”) and any products, services, or content made available through the Site.

By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Site.

2. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will indicate the “Last Updated” date at the top of this page. Your continued use of the Site following the posting of any changes constitutes acceptance of those changes.

3. Eligibility

By using the Site, you represent and warrant that:

  • You are at least 18 years of age, or you are at least 13 years of age and have the consent of a parent or guardian.
  • You have the legal capacity to enter into a binding contract.
  • Your use of the Site will not violate any applicable law or regulation.

4. User Accounts

To access certain features or purchase products, you may be required to create an account. You agree to:

  1. Provide accurate, current, and complete information.
  2. Maintain the security of your password and accept all risks of unauthorized access to your account.
  3. Notify us immediately if you discover or suspect any security breaches related to the Site.

We reserve the right to terminate accounts, remove or edit content, or cancel orders in our sole discretion.

5. Products, Services, and Payments

A. Descriptions and Pricing

We strive to ensure that product and service descriptions are accurate. However, we do not warrant that descriptions, pricing, or other content on the Site are error-free, complete, or current. We reserve the right to correct any errors and to change or update information at any time without prior notice.

B. Payments & Late Fees

We use Intuit QuickBooks and other third-party payment processors to handle secure transactions. By making a purchase, you agree to the following:

  • Authorization: You authorize us to charge your credit card, debit card, or bank account automatically in accordance with your selected payment plan.
  • Late Penalty: If payment is not received by the due date, a 10% (ten percent) late penalty will be charged for every 7 days the payment is late on all outstanding balances.
  • Collections: Any outstanding payments exceeding thirty (30) days will be sent to a collection agency. You agree to pay all amounts due upon demand, together with any applicable collection costs, including attorney’s fees.

C. Invoicing & SMS Notifications

By purchasing our services, you authorize Real Cents Organized and Intuit QuickBooks to send text messages to you for notification of invoices. Message and data rates may apply. You may reply ‘HELP’ for help and ‘STOP’ to cancel future invoice text notifications. Message frequency varies. We do not share your mobile number with third parties for marketing purposes.

D. Refund Policy

All payments are NON-REFUNDABLE. Upon execution of a purchase or service agreement, you are responsible for the full payment amounts. All transactions are final and are not subject to a refund under any conditions.

6. Mobile Messaging (SMS/MMS) Terms

By providing your mobile phone number and opting in to receive text messages from Real Cents Organized, LLC (“we,” “us,” or “our”), you agree to these Mobile Messaging Terms in addition to our Privacy Policy and these Terms of Service.

A. Program Description

Our SMS messaging program is used for: (1) consultation follow-up and lead follow-up, including responses to inquiries submitted through our website, Facebook Lead Ads, and other lead-generation forms; and (2) appointment reminders and booking confirmations for clients and prospects who have scheduled a consultation or service.

B. Opt-In and Consent

You opt in to receive SMS/MMS messages from us by submitting a lead form, contact form, or scheduling form that includes the consent disclosure: “If you check the optional SMS consent checkbox, you agree to receive text messages from Real Cents Organized regarding your bookkeeping consultation request. Message frequency varies, typically 1 to 5 messages per request. Msg & Data rates may apply. Reply STOP to opt out, HELP for help. Consent is not a condition of purchase or service.” Consent is collected at the point of submission and is not a condition of any purchase.

C. Message Frequency

Message frequency varies based on your interaction with us, including lead-stage follow-up, appointment confirmations, and reminders.

D. Message and Data Rates

Message and data rates may apply, depending on your wireless plan and carrier. Carriers are not liable for delayed or undelivered messages.

E. Help and Opt-Out

Reply HELP at any time for assistance, or contact us at info@realcentsorganized.com or (716) 320-0206. Reply STOP at any time to unsubscribe. After replying STOP, you will receive one final confirmation message and no further messages will be sent unless you opt in again.

F. No Sale or Sharing of Mobile Opt-In Data

We will not sell, rent, share, or transfer your mobile phone number, SMS opt-in data, or consent to receive SMS messages to any third parties or affiliates for marketing, promotional, or any other purpose. All other data-sharing categories described in our Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

G. Supported Carriers

Supported carriers include AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, U.S. Cellular, MetroPCS, Virgin Mobile, Cricket, Alltel, and others. T-Mobile is not liable for delayed or undelivered messages.

H. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to opt in to our SMS program. You represent that the mobile number you provide is your own or that you are authorized to consent on behalf of the account holder.

I. Changes to Mobile Messaging Terms

We may update these Mobile Messaging Terms at any time. Continued use of the program after changes are posted constitutes acceptance of those changes. The “Last Updated” date at the top of these Terms reflects when these terms were most recently changed.

7. Service Termination

Unless otherwise specified in a separate written agreement:

  • Notice Period: Termination of ongoing services requires a 30-day written notice, regardless of whether you or the Company is initiating the termination.
  • Obligations: During the 30-day notice period, services will continue to be provided, and you remain responsible for payment covering this period.

8. Intellectual Property Rights

Unless otherwise indicated, the Site and all content and other materials on the Site, including, without limitation, the Real Cents Organized logo, designs, text, graphics, pictures, information, data, software, and sound files (collectively, “Site Content”) are the proprietary property of Real Cents Organized, LLC or our licensors and are protected by U.S. and international copyright and trademark laws.

  • Individual Use Only: Our materials are provided for your individual use only. No license to sell, distribute, or share our materials is granted or implied.

9. Non-Solicitation

You agree not to hire, attempt to hire, or solicit for employment any of our staff members, employees, or third-party contractors (including Virtual Assistants) without our express written consent. A violation of this provision constitutes a breach of contract, and legal action may be taken.

10. Confidentiality & Testimonials

We respect your privacy. However, you agree that we may use case studies of your results or testimonials for marketing purposes. These will be anonymized without reference to your full identity unless we have obtained your specific approval to identify you by name.

11. Prohibited Activities

You agree not to:

  • Use the Site for any illegal purpose or in violation of any local, state, national, or international law.
  • Violate or encourage others to violate any right of a third party, including by infringing or misappropriating any third-party intellectual property right.
  • Interfere with security-related features of the Site.
  • Use any robot, spider, or other automated means to access the Site for any purpose without our express written permission.

12. Disclaimer of Warranties

THE SITE AND OUR PRODUCTS/SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND.

  • No Guarantees: You understand that your results depend on your focus, willingness, and follow-through. We make no guarantees as to the outcome of our services.
  • Methodology: We employ a range of methodologies to suit client needs, and you agree to partake in the methods proposed.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL REAL CENTS ORGANIZED, LLC, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING FROM YOUR USE OF THE SITE OR PRODUCTS.

Release of Liability: By using our services, you voluntarily assume all risks and waive, release, and forever discharge Real Cents Organized, LLC from any responsibility or liability for injuries or damages resulting from your participation in our programs.

14. Indemnification

You agree to defend, indemnify, and hold harmless Real Cents Organized, LLC and our affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the federal courts of the United States or the courts of the State of New York.
